IBED 3732 - Special Topics in Indigenous Treaty Law Credit(s): 3 Lecture Hour(s): 3 Lecture Hours Schedule Type: Lecture This course is developed and delivered by Old Sun Community College, in partnership with MRU, and is tailored to meet the needs of Siksika Nation and individuals reflecting the Siksika Way of Life. Students will explore and examine both the historic and contemporary First Nations - Crown treaties involving the European settler society (French and English). Students will examine both historic and contemporary treaties from a constitutional perspective involving section 35 of the Constitution Act, 1982, including current case law dealing with treaty and aboriginal rights. The significance of the Royal Proclamation of 1763, and the Rupert’s Land and North-Western Order of 1870 and its equitable principles doctrine will be examined. Finally, First Nation - Crown treaty relations will be examined from an economic reconciliation perspective taking into account of recent developments in greater government, private industry and First Nation economic partnerships directly as a result of Supreme Court of Canada decisions favouring First Nations and international developments such as the United Nations Declaration on the Rights Peoples of Indigenous Peoples (2007).
